Stowarzyszenie and Fundacja (Organizer) shall bear joint and several liability for the obligations of the Organizer resulting from these Regulations, as well as they are affiliated creditors with na rzecz Organizatora. W Konkursie PFF bierze udział łącznie do 10 filmów zgłoszonych i zakwalifikowanych do Konkursu PFF zgodnie z postanowieniami niniejszego Regulaminu. 2. 2. M.in. w celu zakwalifikowania filmów do uczestniczenia w ramach Konkursu PFF powołana zostaje Komisja Festiwalowa (dalej: Komisja ). Jednocześnie ustala się, że: 1. Filmy przeznaczone do udziału w Konkursie PFF, mogą być zgłaszane przez ich producentów lub ich dystrybutorów, jak również przez inne podmioty posiadające prawa do korzystania i rozporządzania zgłaszanym filmem (zwanych dalej: Zgłaszającym ). Jednocześnie ustala się, że: 1.1. zgłoszenie filmu do Konkursu PFF jest równoznaczne ze złożeniem Organizatorowi przez Zgłaszającego: (a) zapewnienia o tym, że: (i) Zgłaszający zapoznał się z niniejszym Regulaminem oraz Regulaminem Festiwalu i akceptuje ich treść, (ii) każda z osób, które mogą zostać laureatem Konkursu PFF, zapoznała się z niniejszym Regulaminem oraz Regulaminem Festiwalu i akceptuje ich treść; (b) oświadczenia o udzieleniu Organizatorowi: (i) licencji (odnoszącej się do praw autorskich i praw pokrewnych, z prawem do udzielania sublicencji) na korzystanie z filmu w czasie Festiwalu, w obiektach wykorzystywanych na cele Festiwalu, zgodnie z którą Organizator zostaje upoważniony do korzystania z filmu (w całości, ewentualnie w postaci wybranych fragmentów) poprzez utrwalanie w celach emisyjnych, wyświetlanie, publiczne odtwarzanie, zwielokrotnianie w wybranej technice w celach emisyjnych, wprowadzanie do pamięci komputera w celach emisyjnych; (ii) licencji (odnoszącej się do praw autorskich i praw pokrewnych, z prawem do udzielania sublicencji) na korzystanie z udostępnionych Organizatorowi materiałów informacyjnych (w tym zdjęć) dotyczących filmu, jego producenta i współtwórców na wszelkich znanych polach eksploatacji w celu promocji Festiwalu i/lub Konkursu i/lub danego filmu; 1. Films intended to participate in the PFF competition can be submitted by their producers or their distributors, as well as by other entities having the right to use and dispose of the submitted film (hereinafter referred to as: "Applicant"). At the same time, it is agreed that: 1.1 submitting a film to the PFF Competition is synonymous with submitting to the Organizer by the Applicant: (a) assurance that: (i) the Applicant is familiar with these Regulations and the Regulations of the Festival and accept their content, (ii) each of the persons who may be the winner of the PFF Competition is aware of these Regulations and Regulations of the Festival and accept their content; (b) statement on granting the Organizer: (i) a license (related to copyright and related rights, with the right to a sublicense) to use the film during the Festival, at the premises used for the purposes of the Festival, according to which the Organizer shall be entitled to use the film (as a whole or its fragments) by recording for the emission purposes, to screen, to screen publicly, to multiply in a chosen technique for the emission purposes, to upload it to the computer memory for the emission purposes; (ii) a license (relating to copyright and related rights, with the right to sublicense) to use the informational material (including pictures), shared with Organizer, focusing on the film, its producer and co-authors, on any fields of exploitation for the purposes of promoting the Festival and/or the Competition and/or a chosen film; 1.2 filmy zakwalifikowane do Konkursu PFF 1.2 films selected for the PFF Competition are made Strona (Page) 2 / 10

udostępniane są Organizatorowi bezpłatnie - od Organizatora nie jest należne jakiekolwiek świadczenie lub korzyść innego rodzaju; 1.3 Organizator zastrzega sobie prawo niezakwalifikowania do Konkursu PFF filmów, które w szczególności: (a) zawierają treści nawołujące do nienawiści rasowej, religijnej lub mogące obrażać uczucia religijne, (b) zawierają treści mogące stwarzać zagrożenie dla życia i zdrowia małoletnich, (c) powstały w wyniku działań mogących narażać na utratę życia lub zdrowia ludzi lub zwierząt, (d) w inny sposób mogą naruszać obowiązujące w Polsce przepisy prawa lub dobre obyczaje; 1.4 filmy zakwalifikowane do udziału w Konkursie PFF mogą być dostarczone do Organizatora przez Zgłaszającego wyłącznie na jednym z poniższych nośników w formacie PAL: (a) taśmie 35mm, ze ścieżką dźwiękową zapisaną optycznie lub magnetycznie; (a) BetaSP; (b) DigiBeta; (c) DV Cam; (d) HD Cam; (e) DCP; (f) Blu-ray; 1.5 preferowanymi nośnikami dla filmów będą taśma 35 mm lub HD CAM; w wypadku dostarczenia filmu na innym nośniku niż taśma 35 mm, Organizator ma prawo, bez ponoszenia jakichkolwiek opłat z tego tytułu, dokonać skopiowania przesłanych kopii filmów na dysk komputera w celu przeprowadzenia projekcji Festiwalowych; 1.6 film zawierający dialogi w języku innym niż angielski powinien mieć listy dialogowe w języku angielskim. 2. Film zgłoszony i zakwalifikowany do projekcji w Konkursie PFF nie może być z niego wycofany przez Zgłaszającego ani inną osobę bez pisemnej (pod rygorem nieważności) zgody Organizatora. 3. Organizator pobiera opłaty zgłoszeniowe na zasadach określonych w 4 pkt 2.2 lit. (c) Regulaminu. available for the Organizer for free - the Organizer shall not bear any benefit or advantage of another kind; 1.3 The Organizer reserves the right to not qualify for the PFF Competition, films which in particular: (a) contain a material inciting racial or religious hatred, or may offend religious feelings, (b) contain a material that may pose a threat to the life and health of minors, (c) were made as a result of activities likely to cause the loss of life or health for people or animals, (d) may violate Polish law or good customs; 1.4 films qualified to participate in the PFF Competition may be submitted to the Organizer by the Applicant solely on one of the following media in PAL format: (a) 35 mm film, with the soundtrack recorded optically or magnetically; (a) BetaSP; (b) DigiBeta; (c) DV Cam; (d) HD Cam; (e) DCP; (f) Blu-ray; 1.5 preferred media for films will be a 35 mm film or HD CAM; in case of delivering the film on media other than the 35 mm tape, the Organizer shall have the right, without incurring any charge resulting from it, make a copy of submitted copies of the films, on the computer disc, in order to screen them at the Festival; 1.6 film containing dialogues in a language other than English should have a dialogue list in English. 2. A film submitted and selected for the projection in the PFF Competition cannot be withdrawn by the Applicant or other person without a written (under the pain of nullity) consent of the Organizer. 3. The Organizer collects application fees - in accordance with the principles specified in 4 point 2.2. Strona (Page) 3 / 10

Opłaty Zgłoszeniowe nie podlegają zwrotowi w tym w szczególności w wypadku niezakwalifikowania filmu do projekcji w ramach Festiwalu, albo wycofania filmu z Festiwalu. (c) of the Regulations. Application fees are nonrefundable, including, in particular, in case of films which were not qualified for the Festival screenings, or were withdrawn from the Festival. 4. 4. 1. Do Konkursu PFF może zostać zgłoszony polski film fabularny lub stanowiący odrębną całość artystyczną, którego czas projekcji wynosi nie mniej niż 60 minut. 1. Polish feature film, or as a separate artistic unit, whose projection time shall be not less than 60 minutes, may be submitted to the PFF Competition 2. Zgłoszenie filmu do Konkursu PFF: 2. Submitting the film to the PFF Competition: 2.1 jest możliwe wyłącznie za pośrednictwem aplikacji internetowej dostępnej w serwisie https://www.withoutabox.com/; 2.1 is only possible via web application available on https://www.withoutabox.com/; 2.2. jest skuteczne wyłącznie w wypadku, gdy: 2.2. is effective only if: (a) zostanie dokonane nie później niż do dnia 15 lutego 2015 r.; Organizator zastrzega przy tym, że filmy zgłoszone po dniu 15 lutego 2015 r. mogą (lecz nie muszą) zostać uwzględnione przy tworzeniu listy filmów zakwalifikowanych do projekcji w ramach Festiwalu, o której mowa w 2 pkt. 2 tiret 2. (c) zostanie uiszczona Opłata Zgłoszeniowa w wysokości: - 20,00 USD w wypadku zgłoszeń dokonanych do dnia 30 listopada 2014 r.; - 25,00 USD w wypadku zgłoszeń dokonanych do dnia 30 grudnia 2014 r.; - 30,00 USD w wypadku zgłoszeń dokonanych po dniu 30 grudnia 2014 r.; przy czym Opłata Zgłoszeniowa jest płatna: (i) w USD, (ii) za pośrednictwem dostępnej w serwisie - a selection of images in electronic form or the film s website - 1 to 3 posters; (plus a digital file in TIFF, EPS or PDF format - in quality that enables to print a good-quality poster), - DVD or video clip (only in Beta PAL format) for the purposes of the promotion of the Festival. The Applicant shall be notified about selecting the film, in writing or by electronic means, together with detailed instruction on how to deliver of a copy of the film. 5. 5. 1. Dla laureatów Konkursu PFF przyznana zostanie nagroda regulaminowa - Nagroda dla Polskiego Filmu Fabularnego (robocza nazwa), na którą składają się: 2 statuetki (część prestiżowa) oraz kwota pieniężna (część pieniężna) w wysokości 100.000,00 zł brutto (słownie: sto tysięcy złotych 00/100) z zastrzeżeniem postanowień pkt. 7 niniejszego paragrafu - dla reżysera i producenta zwycięskiego filmu prezentowanego w ramach Konkursu PFF (zwanych dalej: Laureatami KPFF ), wskazanego przez Jury Konkursu PFF (zwanego dalej: Jury ) - wszystkich członków Jury, łącznie z jego Przewodniczącym, powołuje Organizator. Przez producenta rozumie się podmiot, który podejmuje inicjatywę, faktycznie organizuje, prowadzi i ponosi odpowiedzialność za kreatywny, organizacyjny i finansowy proces produkcji filmu. 2. Wymieniona w punkcie 1 niniejszego paragrafu część pieniężna Nagrody dla Polskiego Filmu Fabularnego: 2.1 dzieli się na dwie części: 60% (60.0000,00 zł) - dla reżysera i 40% (40.000,00 zł) - dla producenta; w wypadku, gdy zwycięski film będzie miał więcej niż jednego głównego reżysera lub więcej niż jednego producenta (nie dotyczy koproducentów), Nagroda dla Polskiego Filmu Fabularnego zostanie wypłacona w sposób wskazany w zgodnym pisemnym oświadczeniu odpowiednio - wszystkich głównych reżyserów lub wszystkich producentów zwycięskiego filmu, złożonym Organizatorowi w terminie do końca 2015 roku, pod rygorem utraty prawa do otrzymania części pieniężnej Nagrody dla Polskiego Filmu Fabularnego; 2.2. stanowi kwotę brutto, od której zostanie potrącony podatek dochodowy, zgodnie z obowiązującymi w tym zakresie przepisami prawa w Polsce; 2.3 płatna będzie w terminie do 120 dni licząc od daty jej przyznania, przelewami na rachunki bankowe 1. The producer shall be the person who takes the initiative, actually organizes, leads and is responsible for the creative, financial and organizational process of the film s production. 2. The financial part of the Award for the Polish Feature Film, referred to in point 1 of this paragraph: 2.1 is divided into two parts: 60% (60.0000,00 PLN) - for the director and 40% (40.000, 00 PLN) - for the producer; in the event that the winning film has more than one major director or more than one producer (this does not apply to the co-producers), the Award for the Polish Feature Film shall be paid in the manner indicated in the unanimous written declaration, respectively - all the major directors or all producers of the winning film, submitted to the Organizer no later than by the end of 2015, under pain of loss of the right to receive the financial part of the Award for the Polish Feature Film; 2.2 is the gross amount subject to the income tax, in accordance with the rules in force in this respect of the law in Poland; 2.3 will be payable within a period of 120 days from the date of its granting, by the means of a transfer to bank Strona (Page) 5 / 10

wskazane przez Laureatów KPFF, nie wcześniej jednak niż po podaniu przez nich danych niezbędnych do rozliczenia podatku. 3. Organizator może odmówić wydania części pieniężnej Nagrody dla Polskiego Filmu Fabularnego Laureatowi KPFF, który nie był obecny osobiście na Gali Zamknięcia Festiwalu w chwili ogłoszenia wyboru Laureata KPFF. Organizator nie może odmówić wydania nagrody z powodu wskazanego w zdaniu poprzednim, jeżeli na Gali Zamknięcia w chwili ogłoszenia wyboru Laureata KPFF obecny będzie uprzednio zaakceptowany przez Organizatora na piśmie (pod rygorem nieważności) reprezentant Laureata KPFF. W każdym wypadku braku osobistej obecności Laureata KPFF na Gali Zamknięcia w chwili ogłoszenia wyboru Laureata KPFF, Organizator (o ile nie korzysta z uprawnienia wskazanego w zdaniu pierwszym niniejszego pkt. 3) może wstrzymać się z wydaniem części pieniężnej Nagrody dla Polskiego Filmu Fabularnego w okresie dodatkowych 24 miesięcy licząc od upływu terminu wydania części pieniężnej Nagrody dla Polskiego Filmu Fabularnego, ustalonego zgodnie z innymi postanowieniami niniejszego Regulaminu (w tym także licząc od daty zrealizowania przez Laureata KPFF obowiązków z pkt. 4 niniejszego paragrafu) - bez jakichkolwiek roszczeń ze strony Laureata KPFF wobec Organizatora, w tym w szczególności o zapłatę odsetek. 4. W terminie do 130 dni licząc od przyznania prawa do Nagrody dla Polskiego Filmu Fabularnego, Laureat KPFF reżyser zwycięskiego filmu (dalej: Laureat - Reżyser ) zobowiązany jest do nieodpłatnego przekazania Organizatorowi: 4.1 dwóch zdjęć Laureata - Reżysera po jednym w pionie i poziomie, w jakości 300 DPI (wraz z przeniesieniem praw do takich zdjęć) - na potrzeby promowania Festiwalu (w tym kolejnych edycji Festiwalu); 4.2 stworzonego przez Laureata - Reżysera krótkiego filmu (w jakości emisyjnej na jednym z poniższych accounts indicated by the winners of the PFF Competition, not earlier than after providing the data needed to settle the tax. 3. The Organizer may refuse to give the financial part of the Award for the Polish Feature Film to the Laureate of the PFF Competition, who was not personally present at the Closing Gala of the Festival at the time of announcing the Laureate of the PFF Competition. The Organizer shall not refuse to grant the award due to the reason indicated in the previous sentence, if a representative of the Laureate of the PFF Competition, previously accepted by the Organizer in writing (under the pain of nullity), is present at the time of announcing the Laureate of the PFF Competition at the Closing Gala. In any case of the lack of personal presence of the Laureate of the PFF Competition at the Closing Gala, at the time of announcing the Laureate of the PFF Competition, the Organizer (if not using the right specified in the first sentence of this point 3) may suspend granting the financial part of the Award for the Polish Feature Film in the period of additional 24 months, counting from the expiration of the term of a release of the financial part of the Award for the Polish Feature Film, established in accordance with other provisions of these Regulations (counting from the date of completing the duties specified in the point 4 of this paragraph, by the Laureate of the PFF Competition - without any claims on the part of the Laureate of PFF Competition towards the Organizer, including, in particular, for paying the interests. 4. Within 130 days after granting the right to receive the Award for the Polish Feature Film, the Laureate of the PFF Competition - director of the winning film (hereinafter referred to as: "Laureate - Director") is required to provide, free of charge, the Organizer with: 4.1 two photos of the Laureate - Director, one vertical and the other one horizontal, in the quality of 300 DPI (along with the transfer of the rights to such photos) - for the purposes of promoting the Festival (including subsequent editions of the Festival); 4.2 a short film (in broadcast quality on one of the following carrier Blu-ray, BetaSP, DigiBeta, DV Cam, Strona (Page) 6 / 10

nośników Blu-ray, BetaSP, DigiBeta, DV Cam, HD Cam),wraz z przeniesieniem praw do takiego filmu, zawierającego wypowiedź Laureata - Reżysera o znaczeniu przyznanej mu nagrody i możliwościach, jakie wiąże z przyznaną mu nagrodą - na potrzeby promowania Festiwalu (w tym kolejnych edycji Festiwalu); 4.3 skanu podpisu (autografu) Laureata - Reżysera - na potrzeby promowania Festiwalu (w tym kolejnych edycji Festiwalu); przy czym szczegółowy zakres i warunki realizacji powyższych zobowiązań Laureata - Reżysera zostaną ustalone przez Organizatora. 5. Niezależnie od ustalonych w Regulaminie terminów zapłaty części pieniężnej Nagrody dla Polskiego Filmu Fabularnego, Organizator jest uprawniony do wstrzymania się z zapłatą całości lub części (według decyzji Organizatora) części pieniężnej Nagrody dla Polskiego Filmu Fabularnego, do czasu realizacji przez Laureata - Reżysera całości zobowiązań określonych zgodnie z pkt. 4 niniejszego paragrafu bez jakichkolwiek roszczeń ze strony Laureatów KPFF wobec Organizatora, w tym w szczególności o zapłatę odsetek. Organizator może odmówić wydania niewypłaconej części pieniężnej Nagrody dla Polskiego Filmu Fabularnego w wypadku niewykonania przez Laureata - Reżysera całości zobowiązań określonych zgodnie z pkt. 4 niniejszego paragrafu w terminie 12 miesięcy licząc od daty przyznania prawa do Nagrody dla Polskiego Filmu Fabularnego. 6. Dla laureatów Konkursu PFF najlepszego aktora Konkursu PFF (zwanego dalej: Najlepszym Aktorem KPFF ) oraz najlepszej aktorki Konkursu PFF (zwanej dalej: Najlepszą Aktorką KPFF ), przyznane zostaną nagrody regulaminowe, z których każda to statuetka (część prestiżowa), kwota pieniężna (część pieniężna) w wysokości 10.000,00 zł (słownie: dziesięć tysięcy złotych) oraz zegarek marki Albert Riele (część rzeczowa). Organizator nie może odmówić wydania nagrody z powodu wskazanego w zdaniu poprzednim, jeżeli na Gali Zamknięcia w chwili ogłoszenia wyboru Najlepszego Aktora KPFF lub Najlepszej Aktorki KPFF obecny będzie uprzednio zaakceptowany przez Organizatora na piśmie (pod rygorem nieważności) reprezentant Najlepszego Aktora KPFF lub Najlepszej Aktorki KPFF. W każdym wypadku braku osobistej obecności Najlepszego Aktora KPFF lub Najlepszej Aktorki KPFF na Gali Zamknięcia w chwili ogłoszenia wyboru Najlepszego Aktora KPFF lub Najlepszej Aktorki KPFF, Organizator (o ile nie korzysta z uprawnienia wskazanego w zdaniu pierwszym niniejszego pkt. 6.2) może wstrzymać się z wydaniem części pieniężnej nagrody w okresie dodatkowych 12 miesięcy licząc od upływu terminu wydania nagrody, ustalonego zgodnie z innymi postanowieniami niniejszego Regulaminu - bez jakichkolwiek roszczeń ze strony laureata wobec Organizatora, w tym w szczególności o zapłatę odsetek; 6.3 część pieniężna nagrody dla Najlepszego Aktora KPFF oraz dla Najlepszej Aktorki KPFF: (a) stanowi kwotę brutto, od której zostanie potrącony podatek dochodowy, zgodnie z obowiązującymi w tym zakresie przepisami prawa w Polsce; (b) płatna będzie w terminie do 120 dni licząc od daty jej przyznania, przelewami na rachunki bankowe wskazane przez Najlepszego Aktora KPFF oraz Najlepszą Aktorkę KPFF Laureatów KPFF, nie wcześniej jednak niż po podaniu przez nich danych niezbędnych do rozliczenia podatku oraz nie wcześniej niż po zrealizowaniu obowiązku z lit. c; (c) Najlepszy Aktor KPFF oraz Najlepsza Aktorka KPFF zobowiązani są dostarczyć organizatorowi 2 zdjęcia, po jednym w pionie i poziomie, w jakości 300 DPI (wraz z przeniesieniem praw do takich zdjęć) - na potrzeby and Best Actress of the PFF Competition shall be made by the Jury; 6.2 The Organizer may refuse to give the financial part of the award for the Best Actor of the PFF Competition or the award for the Best Actress of the PFF Competition to the Best Actor or the Best Actress of the PFF Competition, who was not personally present at the Closing Gala of the Festival at the time of announcing the Best Actor or the Best Actress of the PFF Competition. Od łącznej wartości części rzeczowej nagrody specjalnej oraz Świadczenia Dodatkowego Sponsor potrąci kwotę stanowiącą równowartość 10% ich wartości na poczet podatku zryczałtowanego, o którym mowa w art. 30 ust. 1 pkt 2 Ustawy o podatku dochodowym od osób fizycznych z dnia 26 lipca 1991 r. (Dz.U. z 2010 r., Nr 51, poz. 307 ze zm.) i wpłaci na rachunek właściwego Urzędu Skarbowego. Część rzeczowa nagrody nie podlega wymianie na jakikolwiek ekwiwalent, w szczególności ekwiwalent pieniężny 7. Ze względu na skutki trwającego kryzysu finansowego, Organizator zobowiązany jest uwzględnić potencjalne ryzyko niepozyskania środków pieniężnych na pokrycie całości, planowanych w chwili publikacji Regulaminu, kosztów organizacji Festiwalu, w tym na wypłacenie Nagrody dla Polskiego Filmu Fabularnego we wskazanej w niniejszym paragrafie wysokości. Wobec powyższego, Organizator zastrzega sobie uprawnienie do zmiany Regulaminu także w zakresie ustalenia innej niż wskazana w pkt. 1 niniejszego paragrafu wysokości Nagrody dla Polskiego Filmu Fabularnego. Zmiana Regulaminu w powyższym zakresie może być dokonana nie później niż do dnia 31 marca 2015 r. i może polegać na zmniejszeniu wskazanej w pkt. 1 niniejszego paragrafu wysokości Nagrody dla Polskiego Filmu Fabularnego do kwoty nie mniejszej niż 50.000,00 zł. In view of the above, the Organizer reserves the right to change the Regulations, also in respect to determining, other than indicated in point 1 of this paragraph, amount of the Award for the Polish Feature Film. Changes of the Regulations in the above regard can be made not later than March 31, 2015 and can depend on the reduction of the amount of the Award for the Polish Feature Film to no less than 50.000,00 PLN, indicated in point 1 of this paragraph. Changes of the Regulations in the above regard shall not constitute grounds for any claims towards the Organizer including, in particular, for paying the Award for the Polish Feature Film, in the amount before any amendment of the Regulations. 6. 6. 1. Organizator organizuje transport i ubezpieczenie kopii filmowych na potrzeby Festiwalu wyłącznie 1. Organizator nie zwraca / pokrywa kosztów dostarczenia kopii i/lub ubezpieczenia poniesionych przez zgłaszającego lub innego dostawcę kopii, chyba że strony ustalą inaczej w pisemnym (pod rygorem nieważności) porozumieniu. 2. W przypadku utraty lub poważnego uszkodzenia kopii w czasie, w którym kopia znajduje się w posiadaniu Organizatora, odpowiedzialność finansowa Organizatora jest ograniczona do zwrotu producentowi lub dystrybutorowi wyłącznie kosztów wykonania nowej kopii. only for transport, directly from and/or to the actual copy provider. W wypadku odmienności postanowień Regulaminu Festiwalu i niniejszego Regulaminu, pierwszeństwo mają postanowienia niniejszego Regulaminu. 2. Regulamin jest sporządzony w dwóch wersjach językowych: polskiej i angielskiej. W razie sprzeczności między wersjami językowymi, wersja polska jest obowiązująca. Organizator 1. In case of a discrepancy of provisions of the Festival Regulations and these Regulations, the provisions of these Regulations shall prevail. 2. The regulations are prepared in Polish and English.
