Definicje 1. Definitions Niniejszy Regulamin (zwany dalej Regulaminem) ustala warunki uczestnictwa w konferencji pod nazwą CodeForward organizowanej dla programistów (zwanej dalej Konferencją), jak również rodzaje, zakres i warunki świadczenia przez Organizatora usług drogą elektroniczną za pomocą strony. These Rules (hereinafter referred to as Rules ) set forth the conditions for participation in a conference under the name CodeForward organized for IT developers (hereinafter referred to as the Conference), as well as the types, scope and conditions for the electronic provision of services by the webpage by the Organizer. Uczestników dostępna pod adresem www.codeforward.pl Registration of the Participants available at www.codeforward.pl Uczestnik osoba fizyczna, która dokonała Rejestracji i otrzymała Potwierdzenie Uczestnictwa od Organizatora; Participant a natural person who has completed Registration and received Confirmation of Participation from the Organizer; Użytkownik Strony osoba fizyczna mająca dostęp do Strony i jej funkcji w tym zarówno Strona Zamawiająca, jak i Uczestnik; User of the Webpage a natural person accessing the Webpage and its functions, including both an Ordering Party and a Participant; Usługi usługi świadczone elektroniczne i zdefiniowane w ustawie z 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną (Dz. U. z 2013 r. poz 1422) udostępnione Użytkownikom Strony poprzez Stronę, w szczególności: a) rejestracji uczestnictwa w Konferencji poprzez uzupełnienie formularza znajdującego się na Stronie; b) newsletter usługa polegająca na doręczaniu przez Organizatora informacji o Konferencji oraz o możliwości zatrudnienia i kariery u Organizatora. Services services provided electronically as defined in the Electronic Services Provision Act of 18 July 2002 (OJ L 2013, item 1422), made available to Users by the Webpage, including but not limited to: a) registration for participation in the Conference through completion of the form located at the Webpage; b) newsletter a service consisting in the Organizer delivering information about the Conference as well as about the employment opportunities and career in the Organizer. 2. Warunki Ogólne 1. Strona i cała jej zawartość, bez względu na formę, w której jest ona prezentowana stanowi własność Organizatora. Organizator jest upoważniony do dodawania nowych treści, zmiany treści istniejących na Stronie, jak również do usuwania tychże treści w całości lub w części. Powielanie i dystrybucja treści Strony, jak również czynienie jakiegokolwiek innego użytku z jej treści bez uprzedniej wyraźnej zgody 2. General Terms 1. The Webpage and all content contained therein, regardless the form in which it is presented, constitutes the property of the Organizer. The Organizer is authorized to add new content, to modify existing content on the Webpage, and also to remove such content in whole or in part. Copying and distribution of the content of the Webpage, as well as any other use of its content without the explicit prior consent of the Page 3 of 16

Warunki przeprowadzenia konkursów oraz przyznania nagród opublikowane zostaną na Stronie. Organizer, is forbidden. 2. The Webpage may contain information about services provided by third parties. These services will be indicated by the logo or trademark of the entity providing a given service, or by the insertion of a hyperlink to the webpage of a given entity. 3. The Organizer reserves the right to conduct contests during the course of the Conference associated with the theme of the Conference. The terms and conditions for conducting contests and awarding prizes will be published on the Webpage. 3. Zgłoszenie intencji uczestnictwa w Konferencji 1. Dokonanie Rejestracji jest równoznaczne ze zgłoszeniem deklaracji woli zawarcia z Organizatorami umowy dotyczącej uczestnictwa w Konferencji zgodnie z Regulaminem. Dokonanie Rejestracji oznacza również akceptację warunków Regulaminu. 2. Rejestracja powinna być dokonana nie później niż w dniu poprzedzającym dzień, w którym Konferencja ma się odbyć. 3. Strona Zamawiająca powinna uzupełnić formularz rejestracyjny wpisując w nim właściwe i poprawne dane. 4. Organizator nie ponosi odpowiedzialności za szkodę wynikłą z niepoprawności informacji wprowadzonych do formularza rejestracyjnego przez Stronę Zamawiającą. 5. Organizator prześle Potwierdzenie Uczestnictwa Stronie Zamawiającej nie później niż do końca dnia poprzedzającego 3. Submission of intent to participate in the Conference 1. Performing Registration is equivalent to submission of a declaration of will to conclude a contract with the Organizer on participation in the Conference, pursuant to these Rules. Performing Registration also indicates acceptance of the provisions of these Rules. 2. Registration should be performed not later than the day before the day on which the Conference is scheduled to take place. 3. The Ordering Party should complete the registration form with proper and correct information. 4. The Organizer shall not bear liability for loss arising out of incorrect information entered into the registration form by the Ordering Party. 5. The Organizer shall forward Confirmation of Participation to the Ordering Party not later than till the end of the day before the day on Page 4 of 16

Organizator zastrzega sobie prawo odmowy umożliwienia Stronie Zamawiającej uczestnictwa w Konferencji bez podania przyczyny. Organizator nie ma obowiązku przesyłać Stronie Zamawiającej, która nie kwalifikuje się do udziału w Konferencji, informacji o odmowie Potwierdzenia Uczestnictwa w Konferencji. which the Conference is scheduled to take place. 6. Upon receiving Confirmation of Participation, the Ordering Party becomes a Participant of the Conference. 7. The Organizer reserves the right to refuse to allow the Ordering Party to participate in the Conference without providing an explanation. Organizer is under no obligation to forward information about refusal of Confirmation of Participation in the Conference to the Ordering Parties who do not qualify for participation in the Conference. 4. Opłaty 1. Strona Zamawiająca nie jest zobowiązana wnosić jakichkolwiek opłat za uczestnictwo w Konferencji. 2. Organizator, jako podmiot społecznie odpowiedzialny, zachęca Uczestników do wnoszenia dobrowolnych wpłat na rzecz Fundacji Warszawskie Hospicjum dla Dzieci. 3. Dobrowolnych wpłat można dokonywać poprzez stronę internetową pod adresem: http://www.hospicjum.waw.pl/darowizna-ipomoc/wplata-on-line 4. Charges 1. The Ordering Party shall not be obliged to submit any payment for participation in the Conference. 2. As socially responsible entity, the Organizer encourages the Participants to pay voluntary contributions to Fundacja Warszawskie Hospicjum dla Dzieci. 3. The voluntary contributions may be paid via web page at the address http://www.hospicjum.waw.pl/darowizna-ipomoc/wplata-on-line 5. Newsletter 1. W celu skorzystania z usługi Newsletter a świadczonej przez Organizatora, Użytkownik Strony jest zobowiązany udzielić zgodę na otrzymywanie Newsletter a oraz podać swój obecny adres e-mail i kliknąć przycisk potwierdzający chęć otrzymywania Newsletter a. 2. Umowa o dostarczenie usługi polegającej na doręczeniu Newsletter a jest zawarta w 5. Newsletter 1. In order to take advantage of the Newsletter service provided by the Organizer, the User of the Webpage is obliged to give consent to receipt of the Newsletter and to provide a current e-mail address and to click the button confirming his will to receive the Newsletter. 2. Użytkownik może anulować dostarczanie Newsletter a w każdym czasie poprzez kliknięcie linku służącego wycofaniu zgody umieszczonego w każdej wiadomości przesłanej pocztą elektroniczną zawierającej Newsletter i skierowanej do Użytkownika lub poprzez bezpośrednią prośbę o zaprzestanie przesyłania kolejnych edycji Newsletter a skierowaną do Organizatora. concluded at the moment when a User clicks the activation link sent by the Organizer to the e-mail address supplied by the User and in this way confirms its will to receive the Newsletter. 3. The Newsletter service requires that the User expresses his/her consent to the processing of personal data pursuant to the terms and conditions set forth in the present Rules. 4. The content and distribution date of the Newsletter is at the discretion of the Organizer. 5. The User may cancel delivery of the Newsletter at any time by clicking on the withdrawal link located in every e-mail message containing the Newsletter and forwarded to the User, or by requesting directly the Organizer to refrain from forwarding him/her further editions of the Newsletter. 6. Konkursy 1. W Newsletterze skierowanym do Uczestników Konferencji Organizator może zamieścić informację o konkursach organizowanych w czasie Konferencji oraz zamieszcza link do regulaminów konkursów. 2. Rozstrzygnięcia konkursów dokona jury powołane przez Organizatora (zwane dalej Jury). 3. Wydanie nagród zwycięzcom konkursów nastąpi w dniu Konferencji lub też niezwłocznie po jej zakończeniu nie później jednak niż w terminie siedmiu dni. 6. The Contests 1. The Organizer may include in Newsletter addressed to the Users the information about the contests to be organized during the Conference as well as the links to the contest rules. 2. The contests results shall be settled by the jury appointed by the Organizer (hereinafter referred to as the Jury). 3. The awards shall be delivered to the contest winners on the day of the Conference or as soon as possible after the Conference in any case no longer than within seven days. Page 6 of 16

4. Reklamacje związane z konkursami będą przyjmowane przez Organizatora w terminie 7 dni od daty rozstrzygnięcia konkursów pod adresem poczty elektronicznej: AKosinska@luxoft.com 5. Reklamacja powinna zawierać: imię i nazwisko Uczestnika, wskazanie konkursu, którego reklamacja dotyczy, dokładny opis i powód reklamacji. 6. Złożone przez Uczestników reklamacje będą rozpatrywane przez Jury, nie później niż w terminie 14 dni od daty otrzymania reklamacji. 7. Zainteresowani, zostaną powiadomieni o rozpatrzeniu reklamacji wiadomością przesłaną pocztą elektroniczną na adres e- mail, z którego wysłano reklamację. 8. Decyzja co do zgłoszonej reklamacji jest ostateczna, co nie wyłącza prawa Uczestnika do dochodzenia nieuwzględnionych roszczeń na drodze postępowania sądowego. 4. Complaints in relation to the contest shall be received by the Organizer within 7 days from the results settlement at the following e-mail address: AKosinska@luxoft.com 5. The complaint shall comprise: the Participant s name and surname, indication of the contest concerned by the complaint, the detailed description of the reason of the complaint. 6. The complaints submitted by the Participants shall be examined by the Jury no longer than within 14 days from the date of its receipt. 7. Interested parties shall be notified of the complaint s resolution by an e-mail sent to the address from which the complaint was submitted. 8. The decision concerning the complaint s resolution is final which does not exclude the Participant s right to assert not accepted claim by the court. 7. Postanowienia dotyczące umów z konsumentami 1. Utrwalenie, zabezpieczenie oraz przyznanie dostępu do treści warunków umowy zawartej pomiędzy Uczestnikiem, który jest konsumentem a Organizatorem dotyczącej jego udziału w Konferencji odbędzie się poprzez przesłanie Uczestnikowi wiadomości pocztą elektroniczną zawierającej potwierdzenie zawarcia umowy na odległość zgodnie z ustawą z dnia 30 maja 2014 r. o prawach konsumenta (Dz. U. Z 2014 r. poz. 827). 7. Provisions regarding agreements with consumers 1. Recording, securing, provision of access and confirmation of the content of the contract concluded between the Participant who is also a consumer and the Organizer concerning its participation in the Conference shall be performed via forwarding to the Participant an e-mail message containing confirmation of the conclusion of a distance contract pursuant to the Consumer Rights Act of 30 May 2014 (OJ L 2014, item 827). 2. Zgodnie z art. 38 pkt 13 ustawy z dnia 30 maja 2014 r. o prawach konsumenta Uczestnik, który jest konsumentem nie ma prawa odstąpienia od umowy zawartej na odległość z Organizatorem, gdyż dotyczy ona dostarczania treści cyfrowych nie zapisanych na nośniku, a świadczenie zostało spełnione za wyraźną zgodą konsumenta. 3. W wypadku, gdy Uczestnik będący konsumentem wniesie skargę w związku z jakością usługi zaoferowanej przez Organizatora, a organizator skargi nie uzna, wtedy Uczestnik może skorzystać z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń. 4. Pozasądowymi sposobami rozpatrywania reklamacji i dochodzenia roszczeń są między innymi: a. postępowanie przed stałym polubownym sądem konsumenckim działającym przy Inspekcji Handlowej, b. wniosek do wojewódzkiego inspektora Inspekcji Handlowej o wszczęcie postępowania mediacyjnego, c. interwencja powiatowego (miejskiego) rzecznika konsumentów lub organizacji społecznej, do której zadań statutowych należy ochrona konsumentów (np. Federacji Konsumentów, Stowarzyszenia Konsumentów Polskich), d. rozstrzygnięcie sporu poprzez podmiot stosujący pozasądowe metody rozwiązywania sporów za pomocą środków elektronicznego rozstrzygania 2. Pursuant to Art. 38 point 13 of the Consumer Rights Act of 30 May 2014, a Participant who is a consumer does not have the right to withdraw from the distance contract concluded with the Organizer, because the agreement concerns a digital content not recorded on any storage device and the service was performed under the explicit consent of the consumer. 3. In the event a Participant who is a consumer files a complaint in respect of the quality of the services offered by the Organizer, and the Organizer dismisses the claim, the Participant may then make use of extrajudicial means of reviewing the complaint and pursuing claims. 4. Extrajudicial means of reviewing complaints and pursuing claims are, inter alia: a. proceedings before the permanent consumer tribunal at the Trading Standards Authority; b. an application for the initiation of mediation proceedings submitted to the provincial inspector of the Trade Standards Authority; c. intervention of the county (municipal) consumer ombudsman or a nongovernmental organization whose statutory tasks include consumer protection (e.g. Federacja Konsumentów, Stowarzyszenie Konsumentów Polskich); d. settlement of disputes by means of Online Dispute Resolution by entities conducting ADR. Detailed information concerning possibilities for the use of extrajudicial complaint review and pursuit of claims, as well as the rules governing access to such procedures, are available in the offices and on the webpages of county (municipal) ombudsmen, nongovernmental organizations whose statutory tasks include consumer protection, and the Provincial Inspectors of the Trade Standards Authority. 8. Dodatkowe informacje o usługach świadczonych drogą elektroniczną 1. Organizator uprzedza, że system teleinformatyczny, którego używa działa w sposób umożliwiający Użytkownikom Strony zakończenie w każdej chwili korzystania z Usług świadczonej drogą elektroniczną. 2. Organizator uprzedza, że system teleinformatyczny, którego używa, działa w sposób zabezpieczający przed dostępem osób nieuprawnionych do treści transmisji stanowiących Usługi, w szczególności za pomocą kodowania. 3. Organizator zapewni wyraźne określenie stron usługi świadczonej drogą elektroniczną jak również potwierdzenie tego, że Użytkownik rozpoczął korzystanie z Usług wskazanych w niniejszym Regulaminie. 4. Organizator uprzedza, że korzystanie z usług świadczonych drogą elektroniczną połączone jest z ryzykiem. Potencjalne zagrożenia 8. Additional information about services provided electronically 1. The Organizer warrants that the computer system he uses will function in such a manner as to allow every User of the Webpage to terminate at any time using the Service provided via electronic means. 2. The Organizer warrants that the computer system he uses will function in such a manner as to prevent access by unauthorized persons to the content of the transmissions constituting the Services, in particular with the use of encryption. 3. The Organizer shall ensure the explicit identification of the parties to the service provided electronically, as well as confirmation that the User has commenced using the Services described in the present Rules. 4. The Organizer states that the use of electronically provided services is associated with a risk. Potential threats associated with Page 9 of 16

Do zagrożeń należą między innymi: a. złośliwe oprogramowanie rozmaite aplikacje lub skrypty mające niszczycielski, kryminalny lub złośliwy wpływ na system teleinformatyczny użytkownika Internetu, takie jak wirusy, robaki, Trojany, b. oprogramowanie szpiegujące programy śledzące aktywność użytkownika, które zbierają informacje o użytkowniku i przesyłają je ogólnie bez wiedzy ani zgody użytkownika do autora oprogramowania, c. spam niechciana i niezamawiana korespondencja elektroniczna wysłana do wielu odbiorców jednocześnie, często zawierająca treści handlowe, d. phishing oszukańce pozyskiwanie informacji osobistych (np. haseł) poprzez udawanie reprezentowania osób lub instytucji godnych zaufania, e. włamanie do systemu teleinformatycznego z użyciem takich narzędzi jak robaki. 5. Aktualną informację o funkcjach i celu oprogramowania oraz o danych, które nie stanowią treści Usług i które wprowadzone są do systemu teleinformatycznego, z którego korzysta Użytkownik (plikach cookies) można znaleźć w Polityce Plików Cookies stanowiącej część Regulaminu. 6. W celu korzystania ze Strony Użytkownik the use of such services, as well as means and steps which can minimize them, are described in the present Rules. The threats include inter alia: a. malware various applications or scripts of a damaging, criminal or malicious impact on the computer system of an internet user, such as viruses, worms, Trojans; b. spyware software which tracks the activities of a user, which collects information about a user, and sends it generally without the user s knowledge or consent to the author of the software; c. spam unwanted and unordered electronic correspondence sent to many recipients simultaneously, often containing commercial messages; d. phishing fraudulently obtaining personal information (e.g. passwords) by pretending to represent a trustworthy person or institution; e. breaking into telecomputer systems by the use of such tools as rootkit. 5. Current information about the functions and the objective of software and data which does not constitute a component of the content of Services and is introduced into the computer system used by the User (cookies) can be found in Cookies Policy which is the part of the Rules. 6. powinien spełnić następujące wymagania techniczne niezbędne do uzyskania dostępu do systemu informatycznego Organizatora: a. używać wyszukiwarki internetowej: Internet Explorer wersji 10 lub późniejszej, Opera wersji 12.1 lub późniejszej, Firefox wersji 16 lub późniejszej, Google Chrome wersji 23 lub późniejszej, Safari wersji 6.1 lub późniejszej wyposażonej w Javascript oraz z aktywowaną opcją plików cookies; b. posiadać konto e-mail. 7. Organizator nie gwarantuje należytego funkcjonowania systemu teleinformatycznego na urządzeniach mobilnych. Webpage should fulfil the following technical requirements necessary for accessing the Organizer s telecommuter system: a. use web browser: Internet Explorer version 10 or later, Opera version 12.1 or later, Firefox version 16 or later, Google Chrome version 26 or later, or Safari 6.1 or later, with JavaScript and cookies activated; b. possess an e-mail account. 7. The Organizer does not warrant the proper functioning of the telecommuter system on mobile devices. 9. Obowiązki Uczestników 1. Zgłoszenie wiadomości o uczestnictwie w Konferencji stanowi akceptację niniejszego Regulaminu. Użytkownicy zobowiązani są zapoznać się z Regulaminem. 2. Uczestnik ponosi koszty podróży na Konferencję i inne koszty związane z pobytem. 3. W czasie Konferencji Organizator nie może dokonywać fotograficznych lub filmowych utrwaleń prezentacji robionych przez oficjalnych mówców Konferencji. 4. Uczestnictwo w Konferencji stanowi zgodę na wykorzystanie wizerunku Uczestnika, w tym na umieszczanie go w materiałach informacyjnych i promocyjnych Organizatora. Submitting notification of participation in the Conference constitutes acceptance of these Rules. Participants are obliged to familiarize themselves with these Rules. 2. The Participant shall bear the costs of travel to the Conference and other costs of stay. 3. During the Conference the Organizer may not take photos and make video recordings of the presentations delivered by the official speakers of the Conference. 4. Participation in the Conference constitutes consent to the use of the Participant s image, including placing it in informational and promotional materials of the Organizer. The Organizer shall not bear any liability for damage for which Participants are at fault during the Conference. The Participant in the Conference shall bear full legal and material responsibility for losses resulting from his actions or omissions. 10. Zmiany i odwołanie Konferencji 1. Organizator zastrzega sobie prawo dokonania zmian w programie Konferencji. W sczególności zmiany te mogą dotyczyć miejsca Konferencji, czasu jej trwania i programu Konferencji 2. Organizator zastrzega sobie prawo do odwołania Konferencji w każdym czasie bez wskazywania powodu. 3. W przypadku wystąpienia okoliczności, o których mowa w ust. 1 lub 2 powyżej, Organizator opublikuje stosowną informację na Stronie i poinformuje Uczestników pocztą elektroniczną. 4. Organizator nie pokrywa utraconych korzyści ani kosztów poniesionych przez Uczestników w związku ze zmianami, o których mowa w ust. 1 lub 2 powyżej. 10. Changes and cancellation of the Conference 1. The Organizer reserves the right to make changes to the Conference. In particular, these changes may concern: the location of the Conference, its duration and the Conference program. 2. The Organizer reserves the right to cancel the Conference at any time, without giving cause. 3. In the event of the occurrence of the circumstances described in (1) or (2) above, the Organizer shall publish the relevant information on the Webpage and shall inform Participants via e-mail 4. Skargi wniesione po terminie Organizator pozostawia bez rozpoznania. 4. Złożone przez Uczestników skargi będą rozpatrywane przez Organizatora nie później niż w terminie 14 dni od daty otrzymania reklamacji.. 14 Complaints 1. The User has the right to submit complaints regarding the Services provided by the Organizer. A complaint shall be submitted by e- mail sent to: AKosinska@luxoft.com 2. The complaint shall comprise: the Participant s name and surname, the detailed description of the reason of the complaint. 3. The Complaint shall be submitted within 14 days from the day of the Conference. The Complaints submitted after the expiration of the time limit shall be not be considered by the Organizer. 4. The complaints submitted by the Participants shall be examined by the Organizer no longer than within 14 days from the date of its receipt. Page 15 of 16

5. Zainteresowani, zostaną powiadomieni o rozpatrzeniu skargi wiadomością przesłaną pocztą elektroniczną na adres e-mail, z którego wysłano reklamację. 6. Decyzja co do zgłoszonej skargi jest ostateczna, co nie wyłącza prawa Uczestnika do dochodzenia nieuwzględnionych roszczeń na drodze postępowania sądowego. 5. Interested parties shall be notified of the complaint s resolution by an e-mail sent to the address from which the complaint was submitted. 6.
