W ocenie organu orzekajq_cego analiza zebranego w sprawie materialu dowodowego uzyskanego z Zydowskiego Instytutu Historycznego potwierdza podnoszone przez stron okolicznosci przebywania na zeslaniu w ZSRR. W zwi q_ zku z tym, ze nie jest mozliwe precyzyjne ustalenie okresu podlegania represjom, w sprawie zastosowano art. 5 cyt. ustawy. Z tych wzgl d6w majq_c na uwadze tresc wskazanych powyzej przepis6w oraz okolicznosci faktycznych Szef Urz du orzeld jak na wst pie. Wspolna 2/4 Telephone: 22 661 81 11 Fax: 22 661 9073 Decision issued by the Head of the Office for War Veterans and Victims of Oppression dated 11 Feb 2016, No [REDACTED] Pursuant to Article 4, Section 1, Item 3, letter b of the Act of 24 January 1991 on War Veterans and Selected Persons Who Had Been Subject to War and Post- War Oppression (uniform text, Official Journal of 2014, item 1206) in the matter in which the following person is a party to: [NAME REDACTED] acknowledges the veteran rights as a person who for reasons of political, religious and nationality incurred exile and forced deportation to the USSR. Explanation [REDACTED] turned to the Chief of the Office of the application for Permission veterans of the title stay in forced exile in the Soviet Union. Pursuant to Article 22, Section 1 of the Act on War Veterans, the decision as to whether the conditions as outlined in Article 21 are met, is made by the Head of the Office for War Veterans and Victims of Oppressions or a person authorized by the Head, on the basis of a documented application by the person, as well as the recommendation of an association able to confirm the type of veteran activities or repressions. In the opinion of the deciding authority the analysis of the collected evidence confirms that the applicant was in a ghetto.
Owing to the fact that it is not possible to determine precisely the period of residence of the applicant in the ghetto, Art. 5 of the above cited Law was applied. According to the ruling body of analysis on the collected material evidence obtained from the Jewish Historical Institute confirms the circumstances raised by the party on his period of exile in the Soviet Union. In this connection, it is not possible to precisely determine the period of being repressed, the applied art. 5 quoted of the act. The decision of the Head of the Office is made in light of the relevant legislation as indicated above and the established facts. Parties dissatisfied with the decision can contact the Head of the Office for War Veterans and Victims of Oppression and apply for a review within 14 days from the receipt of the decision.
