Teoria, Prawo, Praktyka GERTRUDA UŚCIŃSKA Instytut Polityki Społecznej UW Oddajemy do rąk Czytelników drugi numer Zeszytów Naukowych Zakładu Zabezpieczenia Społecznego Instytutu Polityki Społecznej Uniwersytetu Warszawskiego Zabezpieczenie Społeczne. Teoria, Prawo, Praktyka. Jego zakres przedmiotowy obejmuje zagadnienia teoretyczne, prawne i praktyczne szeroko rozumianego zabezpieczenia społecznego. Wpisuje się on w kontekst aktywności akademickiej podejmowanej i realizowanej w takiej formie w innych obszarach naukowych na Uniwersytecie Warszawskim. Obecny numer czasopisma został przygotowany i opracowany na podstawie ostatnio podejmowanych działań prawnych i pozaprawnych w Polsce oraz w innych krajach Unii Europejskiej dotyczących zabezpieczenia społecznego, ze szczególnym uwzględnieniem zagadnień emerytalnych. Zgodnie bowiem z przyjętą koncepcją w każdym numerze podejmuje się wiodący temat badawczy. W zakresie systemów emerytalnych dokonują się istotne zmiany w krajach Unii Europejskiej, a także w podejściu unijnym, które przywołuje się często w dyskursie publicznym. W celu pełnego przedstawienia niektórych z tych zmian w numerze znajduje się artykuł poświęcony reformom systemu emerytalnego na Węgrzech oraz wynikającym z nich konsekwencjom. Jestem przekonana, że artykuł ten będzie przydatny do prac naukowych i dyskusji o tych zmianach. W związku z dokonanymi w ostatnim czasie modyfikacjami w polskim systemie emerytalnym w numerze zawarto kilka opracowań podejmujących tę tematykę. Podjęto również zagadnienia dotyczące kwestii wolności w systemie ubezpieczeń społecznych. Redakcja przyjęła, że teksty zawarte w tym numerze czasopisma powinny zwiększać wiedzę na temat zmian w systemie emerytalnym w Polsce i w innych krajach oraz przedstawiać analizę prawną, społeczną i ekonomiczną dotyczącą tych systemów. W dziale Studia i Problemy omawiamy podjęte przez autorów ekspertów w dziedzinie zabezpieczenia społecznego ważne zagadnienia teoretyczne, prawne i praktyczne dotyczące systemów emerytalnych. Teksty te odnoszą się do sytuacji w Polsce i w krajach europejskich oraz regulacji UE z tego zakresu. W dziale tym zawarto również opracowanie na temat sytuacji obywateli polskich w niemieckim systemie społecznym, który jest pierwszą taką publikacją w Polsce. Autor podejmuje bardzo ważne sprawy wpisujące się w kontekst badań nad skutkami prawnymi i społecznymi migracji i reemigracji. Temat ten będzie kontynuowany na łamach naszego pisma. W dziale Sprawy Międzynarodowe zostały przedstawione aktualne zagadnienia, którymi zajmuje się obecnie Unia Europejska, Międzynarodowa Organizacja Pracy i Rada Europy, ze szczególnym uwzględnieniem systemów emerytalnych. 5
STUDIA I PROBLEMY Analizy prawne wymagają przedstawienia oceny ich funkcjonowania, dokonanej przez sądy krajowe i międzynarodowe. Ważnym działem naszego czasopisma naukowego jest analiza orzecznictwa, w którym prezentowane są wyroki sądów polskich i europejskich z zakresu zabezpieczenia społecznego i ich wpływ na praktykę stosowania prawa zabezpieczenia społecznego (dział Orzecznictwo). W tym numerze prezentowana jest analiza orzecznictwa podejmującego sprawy dotyczące prawa do swobodnego przemieszczania się i ochrony socjalnej. W części wywiady, rozmowy z ekspertami polskimi zaprezentowano rozmowę z przedstawicielem środowiska akademickiego na temat przyczyn reform otwartych funduszy emerytalnych. Z kolei w dziale Nowości Wydawnicze publikujemy informacje o nowych książkach, a także artykułach publikowanych w czasopismach naukowych, ze szczególnym uwzględnieniem wydawnictw zagranicznych. Czasopismo prowadzi współpracę z ekspertami z zagranicznych ośrodków akademickich. W związku z tym uznano, że niektóre teksty i opracowania będą publikowane także w języku angielskim. W tym numerze pisma zamieszczamy teksty prof. J. Hajdú oraz jego doktorantki D. J. Lados z Uniwersytetu w Szeged na Węgrzech oraz prof. B. Schulte z Research Fellow at the Max Planck Institute for Foreign and International Social Law na temat zagadnień dotyczących systemów emerytalnych. Mając na celu jak najszerszą integrację rodziny europejskiej specjalizującej się w problematyce zabezpieczenia społecznego w aspektach prawnych i pozaprawnych, zachęcamy do współpracy studentów, doktorantów i wyższą kadrą akademicką uczelni polskich i zagranicznych. 6

Practice GERTRUDA UŚCIŃSKA Instytut Polityki Społecznej UW We are glad to present the third issue of the Journal issued by the Social Security Department of the University of Warsaw, entitled Social Security. Theory. Law. Practice, which covers in its scope the theoretical, legal and practical aspects of social security. This Journal results from the engagement and initiative on the part of students, graduates, Ph.D. students and social security scholars postulating the need for a broad and complex approach to social security in its different aspects and dimensions. It is important to underline that this Journal is mostly the result of academic activity and research undertaken by young persons, supported here by more experienced scholars and experts in the field. The Journal follows similar projects at the University of Warsaw and hopes to offer valuable content in the field of academic research on social security legislation, theory and practice. The main focus of the third issue of the Journal is on the topic of old-age pension in its legal and social aspects. It is inspired by a number of legal and extra-legal initiatives and activities recently undertaken both in Poland and in the European Union at large, which address the broad problem of old-age pension. The problem of social security for the elderly and the provision of old-age pension continue to be the subject of debate, reform, readjustment and study across the EU, and in order to reflect these ongoing transformations a study on Hungarian old-age pension scheme is included in the present issue of the Journal, which contains the discussion on the consequences of the recent pension reform in Hungary. In light of the reforms introduced in the Polish old-age pension scheme, in turn, several articles address also these recent changes. The editorial board of the Journal wishes to increase the awareness and improve knowledge on old-age pension schemes in different target groups, to present legal, social and economic analytical studies on its different aspects and enable the exchange of information on current developments in the area. The academic part of this Journal follows the steps and decisions, both legal and outside legislative process, in the area of old-age pension in Poland and Europe, with an emphasis on the developments in Poland and other EU Member States. The problems discussed are of vital importance for the society and should be examined, as we believe, not only in their national dimension, but also from the European and global perspective. The Studies and Problems section includes important theoretical and legal problems in the field of old-age pension raised by prominent European experts and scholars as well as students and graduates. The papers address both the current situation in Poland and the broader European 7
perspective. An article on the situation of Polish migrants in German social security scheme is included, for instance, which is the first publication on this important issue in Poland. The author discusses a number of problems connected with the legal and social consequences of migration and remigration. This subject will be continued in the following issues of the Journal. Since the aim of the Journal is also to update readers on the current international developments, the International Affairs section focuses on the issues that are currently addressed by the European Commission, International Labour Organization and the Council of Europe, with a special focus on the old-age pensions. Legal studies demand that the evaluations and interpretations of law made by Courts and Tribunals be presented and interpreted. Analyzing case-law is an important part of this Journal and the Case-Law section focuses on the impact of current jurisprudence on old-age pension schemes. To fulfill the task of informing students and scholars, the New Books section informs on new titles (both books and articles in academic journals) in the field, with a focus on foreign titles. From the point of view of dissemination of knowledge and information, this section is an important element of our project. It appears to us that an important part of this Journal that deserves attention is formed by the interviews with accomplished experts from the field, both Polish and European. We wish to present their opinions on current policy issues as well as academic cooperation and research in the field of social security. In the present issue, the subject of old age pension will be discussed. The initiative to start a new title in the field of social security studies has been supported by numerous experts and acclaimed scholars all over Europe, who generously agreed to cooperate on different levels, also by contributing articles that will be published here in English. In this third issue of the Journal, we include an article by Professor B. Schulte, a Research Fellow at the Max Planck Institute for Foreign and International Social Law. An article by Proffesor J. Hajdú, written with his PhD student, D. J. Lados, is also included. Moreover, all the articles published in the Journal are followed by their summaries in English. The present Journal is open for cooperation with students, academic staff and scholars in Poland and abroad. We aim at integrating the European community of people interested in social security policies and schemes, their legal and social aspects. We invite commentaries, proposals and contributions and we hope to further develop and improve our academic Journal. 8
