W pismach z dnia 3 i 7 października 2011 r., zarejestrowanych w dniach 5 i 11 października 2011 r. (Ares (2011)1057393 i (2011)1081042) władze polskie powiadomiły Komisję Europejską o wspomnianych wyżej odroczeniach dla czterech stref jakości powietrza: aglomeracji warszawskiej (NO2), miasta Włocławek (NO2), aglomeracji krakowskiej (NO2) i powiatu kędzierzyńsko-kozielskiego (benzen). Dla trzech z czterech przedmiotowych stref powiadomienia zostały już wcześniej przesłane a Komisja zgłosiła wobec nich zastrzeżenia. Powiadomienia dla stref: warszawskiej (NO2), krakowskiej (NO2) i kędzierzyńsko-kozielskiej (benzen) stanowią zatem ponowne powiadomienia. Po wstępnej analizie Komisja uznała, że powiadomienia są niekompletne Władze polskie są zatem proszone o dostarczenie informacji określonych w załączniku, w celu ułatwienia określenia stanowiska Komisji w sprawie przedmiotowych odroczeń. Informacje te Stałe Przedstawicielstwo Rzeczypospolitej Polskiej powinno przekazać Sekretariatowi Generalnemu Komisji w terminie trzech tygodni od daty niniejszego pisma. Okres oceny rozpocznie się w dniu następującym po dniu oficjalnej rejestracji przez Komisję wymaganych informacji. Jeśli wymagane informacje nie zostaną przedstawione w tym terminie Komisja zastrzega sobie prawo do zgłoszenia zastrzeżeń wobec tych elementów powiadomienia, które nie zostały wystarczająco uzasadnione, oraz - ze względu na pewność prawną - w terminie dziewięciu miesięcy od daty urzędowej rejestracji pierwszego powiadomienia. ANNEX Member States must according to Article 22(4) of Directive 2008/50/EC provide all relevant information necessary for the Commission to assess whether or not the relevant conditions are satisfied. The information considered necessary by the Commission for that purpose has been further specified in Commission Communication COM (2008)403 final and Staff Working Papers SEC(2008)2132 and SEC(2011)300. In examining the notification of the Polish authorities, the Commission finds that additional information is required for the assessment. In the questionnaire according to Decision 2004/461/EC, compliance with the limit values for NO2 was reported for this zone for 2010. Once the limit value is complied with, there may be no need to further extend the compliance date, unless compliance was due to exceptionally favorable atmospheric conditions. In the notification documents, no claim was found that NO2 levels were exceptionally low due to favorable atmospheric conditions. Please provide evidence for exceptional atmospheric conditions, if applicable. Because the extension period may not be longer than necessary, please confirm by which year compliance with the limit value is projected. ; Aglomeracja Krakowska ; Mp07MKRNO2a01 It is stated in the comment in Form 3 that contributions from fugitive emission sources will be specified after a measurement campaign. As the Commission's decision on the previous notification found that the source apportionment available at present is not precise enough to allow for an assessment, please provide additional information on the sources contributing to the local benzene increment. In Forms 4A (sub c) the estimated level of benzene is requested. The numbers given in these forms seem to be very low. Please provide the benzene level (expected level in 2010 without additional measures) in Form 4A sub c. Please also provide the quantitative impact of measures on the benzene level in Annex to Form 5A and Annex A to Form 7, ifpossible. In the comment in Form 3B, some information is given why the benzene limit value was not complied with in 2010. However, quantitative information on the contributions at the exceedance situation, as requested in Form 3B, seems to be missing. Please provide this information, ifpossible. In Forms 4A and 4B (sub c) as well as 5A and 5B (sub g), the estimated level of NO2 is requested. The numbers given in these forms seem to be very low (they should be expected around 40μg/m 3 ). Please confirm whether these are actual concentrations in μg/m 3 or otherwise provide the expected concentrations. Aglomeracja Warszawska Description of information required The Commission had raised objections against the postponement of the deadline for the NO2 limit value for this zone because it was not possible to assess if conformity with limit value can be achieved by 2015 or earlier. Related to this, the Polish authorities provided various letters related to the timetable of the measures provided in the air quality plan. It follows from the letter that parts of the bypass roads are planned to be completed in 2011 but other parts will either start in the period 201U to 2014 only or their timetable is still open. Based on this information, it is still not possible to assess whether the limit value can be complied with by 2015. In order to allow for an assessment, please provide the following information: - An updated air quality plan which contains measures that will be implemented before the deadline of 2015. - For these measures, information on their effect on NO2 emissions and on ΝΟχ (NO2) levels (effect of individual measures as well as effect of all measures combined). You may use Form 5B, Annex to Form 5B, Form 7 and Annex Β to Form 7 to provide this information. In Annex to Form 5B and in Annex Β to Form 7 it is stated that additional measures will be implemented once more information on the benzene sources is available. In Annex 1 to the notification forms, information on additional measures and activities related to benzene emissions is given. However, a time extension is possible only if measures are clearly defined and planned to be taken and it can be shown that they will reduce the benzene level below the limit value. Therefore, please provide information on specific additional measures, including their effects on the benzene level at the location in exceedance, in order to demonstrate that the limit value will be complied with in 2015. Third condition - Air Quality Plan & consistency with requirements of Part A of Annex XV of the Directive The air quality programme of 2011, which is referenced as "Publikacja nr 1" in Annex to form 1, was not found under the weblink provided. Fourth condition - Status of implementation of Community air pollution legislation in Part В of Annex XV of the Directive and consideration of certain measures in section 3 of Part В of Annex XV of the Directive KP07mWlNO2h01: In Form 5B, the impact of measures on NO2 levels is missing. In Annex B to Form 7, information on the total impact is given, but no information on the effect of individual measures. Please provide in Form bb information on the total impact and in Annex В to Form 7 information on the effect of individual measures (emission reduction and impact on ambient air concentrations). In Form 9, information on the first plan or programme and on a short term action plan is missing. Please provide the date on which the first plan or programme (or air quality plan) was adopted and provide information on the short-term action plan. Alternatively, confirm that the air quality programme of 2011 is the first such document and no shortterm action plan was adopted. In Form 9 it is stated that LPC and WID are not relevant. For completeness, please confirm whether or not any LCP or WID installations jointly contribute > 3 % to the NO x (NO2) level at the exceedance situation.
