6 Section III : Legal, economic, financial and technical information III.1) Conditions relating to the contract: III.1.1) Deposits and guarantees required: (if applicable) Prior to the deadline for submission of final bids, the Contracting Authority shall request the Economic Operator to submit a bid bond (deposit) in the amount of: PLN (in words: five hundred thousand PLN) in one of the forms in the Article 25 section 3 of the Rules of Preparing and Conducting Contract Award Procedures Based on EU Directive by Companies of EDF Group in Poland (hereinafter: the Rules) Note: at the stage of submitting applications to participate in the proceeding, the bid bond (deposit) is not required. Performance Security is required when signing the contract, in one of the forms in Article 26 sec. 2 of the Rules and on the basis of the conditions foreseen in the Rules. / Przed upływem terminu do składania ofert, Zamawiający będzie wymagać od Wykonawcy wniesienia wadium w wysokości PLN (pięćset tysięcy złotych) w jednej z form przewidzianych w paragrafie 25 ustęp 3 Regulaminu Przygotowywania i Prowadzenia Postępowań o Udzielenie Zamówień przez Spółki Grupy Kapitałowej EDF w Polsce (dalej Regulamin"), przygotowanego na podstawie i zgodnie z Dyrektywą UE. Uwaga: wadium nie jest wymagane na etapie składania wniosków o dopuszczenie do udziału w postępowaniu. Zamawiający będzie wymagał na etapie podpisywania umowy wniesienia zabezpieczenia należytego wykonania umowy w jednej z form przewidzianych w paragrafie 26 ustęp 2 Regulaminu i na zasadach przewidzianych w Regulaminie. III.1.2) Main financing conditions and payment arrangements and/or reference to the relevant provisions governing them: Detailed conditions and dates of payments for the works being the object of the award shall be defined in the draft contract to be provided to selected participants at the later stage of the proceedings, in due time before the deadline for bids submission. / Szczegółowe warunki i terminy płatności za prace będące przedmiotem zamówienia zostaną określone we wzorze umowy, który zostanie przekazany w późniejszej fazie postępowania Wykonawcom zakwalifikowanym do dalszych jego etapów, w odpowiednim czasie przed upływem terminu składania ofert. III.1.3) Legal form to be taken by the group of economic operators to whom the contract is to be awarded: (if applicable) Economic Operators competing jointly for the award should appoint a proxy acting based on power of attorney (being one of the consortium members or a third party) to represent them in the proceedings, or to represent them in the proceedings and to conclude the contract. The power of attorney should clearly define the proceedings to which it refers and the range of activities to which the attorney is authorized. It shall also indicate the attorney, and all the Economic Operators who have jointly applied for the contract. The power of attorney (signed by authorized persons) must accompany the application for admission to participate in the proceedings, as an original document or a certified true copy (a notarized copy). Economic Operators acting jointly shall be jointly and severally liable for the obligations arising from the contract. Before concluding the contract the Contracting Authority will require the contract governing cooperation rules between the members of the Consortium (Consortium Agreement) jointly applying for the contract to be submitted. / Wykonawcy wspólnie ubiegający się o udzielenie zamówienia zobowiązani są ustanowić pełnomocnika działającego na podstawie udzielonego pełnomocnictwa (będącego jednym z członków konsorcjum lub osobą EN Standard form 05 - Contract notice utilities 6 / 27

7 trzecią) do reprezentowania ich w postępowaniu albo do reprezentowania ich w postępowaniu i do zawarcia umowy. Pełnomocnictwo powinno jednoznacznie określać postępowanie, do którego się odnosi, zakres czynności, do których został umocowany pełnomocnik, wskazywać pełnomocnika, jak również wszystkich Wykonawców wspólnie ubiegających się o udzielenie zamówienia. Pełnomocnictwo (podpisanej przez upoważnione osoby ) należy załączyć do wniosku o dopuszczenie do udziału w postępowaniu w oryginale albo w kopii poświadczonej notarialnie. Wykonawcy wspólnie ubiegający się o udzielenie zamówienia będą solidarnie odpowiedzialni za zobowiązania wynikające z umowy. Przed zawarciem umowy Zamawiający będzie żądał przedstawienia umowy regulującej współpracę Wykonawców wspólnie ubiegających się o udzielenie zamówienia (umowy konsorcjum). III.1.4) Other particular conditions: (if applicable) The performance of the contract is subject to particular conditions : yes no (if yes) Description of particular conditions: III.2) Conditions for participation: III.2.1) Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers: Information and formalities necessary for evaluating if the requirements are met: Only Economic Operators satisfying the conditions for participation in the proceedings set forth in this contract notice will be admitted to the further stages of the proceedings. The assessment of Economic Operators will be conducted on the basis of provided documents and statements. The Economic Operators who will not meet the requirements will be excluded from proceedings. In confirmation of fulfillment of conditions for participation in the proceedings, the Economic Operator shall submit: A. Statement of compliance with the conditions laid down in Article 9 sec. 3 of the Rules, i.e., that the Economic Operators meets the conditions relating to: - holding a permission to perform specific work activities or actions, if laws are required by their possession, - having knowledge and experience, - having appropriate technical capacity and personnel capable of performing the contract, - economic and financial situation, - requirements concerning work safety and hygiene and environment protection in business activity, - reliability and correctness of performance of contracts so far entrusted to the economic operators by any of EDF Group companies in Poland and around the world. (Note: For Economic Operators jointly applying for the award of the contract, the statement can be filed jointly by the members of the consortium). B. Statement of the Economic Operator, confirming that: - the Economic Operator, and any of its dominant entities within the meaning of the Accountancy Act dated 29 September 1994 are not and/or are not becoming bankrupt or insolvent, going into liquidation, having a receiving or administration order made against them, compounding with their creditors, or carrying on business under a receiver, trustee or manager for the benefit of their creditors, or any act done or event occurring which (under any applicable laws) has a similar effect to any of these acts or events; and - the Economic Operator and any of its dominant entities within the meaning of the Accountancy Act dated 29 September 1994 shall satisfy in due time their payment obligations; - the Economic Operator and any of its dominant entities within the meaning of the Accountancy Act dated 29 September 1994 are not in arrears with payment of taxes, or that they obtained an exemption, deferral or EN Standard form 05 - Contract notice utilities 7 / 27

8 payment in installments of overdue payments or suspension in whole of the execution of the decision of the competent authority; - the Economic Operator and any of its dominant entities within the meaning of the Accountancy Act dated 29 September 1994 are not in arrears with payment of health and social security insurance contributions, or that they obtained an exemption, deferral or payment in installments of overdue payments, or suspension in whole of the execution of the decision of the competent authority; - the Economic Operator and any of its dominant entities within the meaning of the Accountancy Act dated 29 September 1994 have not been convicted for anything related to their professional integrity and behavior; - the Economic Operator and any of its dominant entities within the meaning of the Accountancy Act dated 29 September 1994 have not committed a serious professional misdeed; - the Economic Operator and any of its dominant entities within the meaning of the Accountancy Act dated 29 September 1994 are not in conflict of interest with the objectives of the Contracting Entity." Based on the template provided by the Contracting Authority (Note: For Economic Operators jointly applying for the award of the contract, the documents should be filed by each of the members of the consortium). Any time prior to the selection of the most advantageous tender, the Contracting Entity may require Economic Operators to evidence him by the means of submitting documents required by the Contracting Entity which prove the items specified in this statement. The Contracting Entity may require in particular but not limited to the following documents: - Current certificate of the head of the competent tax office confirming that the Economic Operator and any of its dominant entities within the meaning of the Accountancy Act dated 29 September 1994 are not in arrears with payment of taxes, or certificate that they obtained an exemption, deferral or payment in installments of overdue payments or suspension in whole of the execution of the decision of the competent authority, - Current certificate of the competent branch of the Social Insurance Institution (ZUS) or Agricultural Social Insurance Fund (KRUS) stating that the Economic Operator and any of its dominant entities within the meaning of the Accountancy Act dated 29 September 1994 are not in arrears with payment of health and social security insurance contributions, or confirmation that they obtained an exemption, deferral or payment in installments of overdue payments, or suspension in whole of the execution of the decision of the competent authority. For Economic Operators or their dominant entities within the meaning of the Accountancy Act dated 29 September 1994 established or having a place of residence outside the Republic of Poland, the Contracting Entity may require the document or documents issued in the country in which the Economic Operator or a given dominant entity has his registered office or has a place of residence If the Contracting Entity finds failure to comply on the basis of documents or refusal to submit required documents it may lead to exclusion of the Economic Operator from the procedure. C. Recent extract from the register, if separate regulations require registration, to demonstrate that there are no grounds for exclusion under Article 30 sec. 1 item (b) of the Rules, issued not earlier than 6 months before the deadline for filing applications for participation in the proceedings. (Note: For Economic Operators jointly applying for the award of the contract, the documents should be filed by each of the members of the consortium); D. Foreign Persons/Economic Operators: For Economic Operators established or having a place of residence outside the Republic of Poland, then instead of the documents referred to in point C, - the Economic Operator shall submit the appropriate document or documents issued in the country in which he has his registered office or has a place of residence, confirming that no liquidation proceedings have been opened in respect of the Economic Operators and the Economic Operator has not been declared bankrupt. The documents referred to in items C and D) above should be issued not earlier than 6 months before the deadline for filing applications for participation in the proceedings., If, in the place of residence of the individual or the country where the Economic Operator has his registered office or place of residence the documents referred to in items C and D above are not issued, they shall be replaced by a document containing a statement made before a notary public, competent judicial, administrative authority or professional or trade government body having jurisdiction over the place of residence of such person or the country in which the Economic Operator has its registered office or place of residence. 9 Evaluation Criteria Qualifying evaluation shall be made on the basis of required documents and declarations, according to the criterion: meets or does not meet the criterion. / Do udziału w dalszych etapach postępowania zostaną dopuszczeni wyłącznie Wykonawcy, którzy spełniają warunki udziału w postępowaniu, o których mowa w tym ogłoszeniu. Ocena spełniania przez Wykonawców warunków udziału w postępowaniu dokonana zostanie na podstawie dostarczonych dokumentów i oświadczeń. Wykonawcy, którzy nie spełniają tych warunków, zostaną wykluczeni z postępowania. Na potwierdzenie spełniania warunków udziału w postępowaniu, Wykonawca zobowiązany jest przedłożyć: A. Oświadczenie Wykonawcy o spełnianiu warunków określonych w par. 9 ust. 3 Regulaminu dotyczących: - posiadania uprawnień do wykonania określonej działalności lub czynności, jeżeli przepisy prawa nakładają obowiązek ich posiadania, - posiadania wiedzy i doświadczenia, - dysponowania odpowiednim potencjałem technicznym oraz osobami zdolnymi do wykonania zamówienia, - sytuacji ekonomicznej i finansowej - dotyczących bezpieczeństwa i higieny pracy oraz ochrony środowiska w prowadzonej działalności, - rzetelności i prawidłowości realizacji przez wykonawców dotychczasowych zamówień udzielonych przez którąkolwiek ze spółek z grupy EDF w Polsce i na świecie. (Uwaga: W przypadku Wykonawców wspólnie ubiegających się o udzielenie zamówienia, oświadczenie może być złożone wspólnie przez członków konsorcjum). B. Oświadczenie złożone przez Wykonawcę, potwierdzające, że: - Wykonawca ani żadna z jego jednostek dominujących w rozumieniu ustawy z dnia 29 września 1994 r. o rachunkowości nie jest lub nie grozi jej upadłość lub niewypłacalność lub likwidacja, nakaz egzekucji lub nakaz administracyjny wydany wobec niego, zawarcie ugody z jego wierzycielami lub prowadzenie działalności pod nadzorem zarządcy, syndyka lub kierownika z korzyścią dla jego wierzycieli, lub dowolne wykonane działanie lub powstałe zdarzenie, które (zgodnie z prawem właściwym) ma podobne skutki do tychże działań bądź zdarzeń; i - Wykonawca i każda z jego jednostek dominujących w rozumieniu ustawy z dnia 29 września 1994 r. o rachunkowości realizuje i nie przestanie terminowo realizować swoich zobowiązań płatniczych; - Wykonawca ani żadna z jego jednostek dominujących w rozumieniu ustawy z dnia 29 września 1994 r. o rachunkowości nie zalega z opłacaniem podatków, lub że uzyskała przewidziane prawem zwolnienie, odroczenie lub rozłożenie na raty zaległych płatności lub wstrzymanie w całości wykonania decyzji właściwego organu; - Wykonawca ani żadna z jego jednostek dominujących w rozumieniu ustawy z dnia 29 września 1994 r. o rachunkowości nie zalega z opłacaniem składek na ubezpieczenie zdrowotne i społeczne, lub że uzyskała przewidziane prawem zwolnienie, odroczenie lub rozłożenie na raty zaległych płatności, lub wstrzymanie w całości wykonywania decyzji właściwego organu - Wykonawca, ani żadna z jego jednostek dominujących w rozumieniu ustawy z dnia 29 września 1994 r. o rachunkowości, nie została skazana za żadne przestępstwo związane z ich zawodową działalnością; - Wykonawca, ani żadna z jego jednostek dominujących w rozumieniu ustawy z dnia 29 września 1994 r. o rachunkowości nie dopuściła się poważnego zawodowego wykroczenia; - Wykonawca, ani żadna z jego jednostek dominujących w rozumieniu ustawy z dnia 29 września 1994 r. o rachunkowości nie pozostaje w konflikcie interesów z celami Zamawiającego. Zgodne z wzorem dostarczonym przez Zamawiającego. (Uwaga: W przypadku Wykonawców wspólnie ubiegających się o udzielenie zamówienia, dokumenty powinny być złożone przez każdego członka konsorcjum). W każdym momencie do chwili dokonania wyboru najkorzystniejszej oferty Zamawiający może żądać od Wykonawców przedstawienia dowodów w postaci złożenia dokumentów wymaganych przez Zamawiającego na potwierdzenie okoliczności wskazanych w oświadczeniu. Zamawiający może żądać w szczególności, ale nie wyłącznie następujących dokumentów: EN Standard form 05 - Contract notice utilities 9 / 27

10 - Aktualnego zaświadczenia właściwego naczelnika urzędu skarbowego potwierdzające, że Wykonawca ani żadna z jego jednostek dominujących w rozumieniu ustawy z dnia 29 września 1994 r. o rachunkowości nie zalega z opłacaniem podatków, lub zaświadczenie, że uzyskała przewidziane prawem zwolnienie, odroczenie lub rozłożenie na raty zaległych płatności lub wstrzymanie w całości wykonania decyzji właściwego organu, - Aktualnego zaświadczenia właściwego oddziału Zakładu Ubezpieczeń Społecznych lub Kasy Rolniczego Ubezpieczenia Społecznego, potwierdzające, że Wykonawca ani żadna z jego jednostek dominujących w rozumieniu ustawy z dnia 29 września 1994 r. o rachunkowości nie zalega z opłacaniem składek na ubezpieczenie zdrowotne i społeczne, lub potwierdzenie, że uzyskała przewidziane prawem zwolnienie, odroczenie lub rozłożenie na raty zaległych płatności, lub wstrzymanie w całości wykonywania decyzji właściwego organu. Jeżeli Wykonawca lub jego jednostka zależna lub dominująca w rozumieniu ustawy z dnia 29 września 1994 r. o rachunkowości ma siedzibę lub miejsce zamieszkania poza terytorium Rzeczpospolitej Polskiej, Zamawiający może żądać dokumentów, wystawionych w kraju, w którym Wykonawca lub dana jednostka dominująca ma siedzibę lub miejsce zamieszkania. Stwierdzenie przez Zamawiającego nieprawidłowości złożonych oświadczeń na podstawie dokumentów albo w przypadku odmowy przedstawienia wymaganych dokumentów może prowadzić do wykluczenia Wykonawcy z udziału w postępowaniu. C. Aktualny odpis z właściwego rejestru, jeżeli odrębne przepisy wymagają wpisu do rejestru, w celu wykazania braku podstaw do wykluczenia w oparciu o par. 30 ust. 1 pkt (b) Regulaminu, wystawiony nie wcześniej niż 6 miesięcy przed upływem terminu składania wniosków o dopuszczenie do udziału w postępowaniu o udzielenie zamówienia. (Uwaga: W przypadku Wykonawców wspólnie ubiegających się o udzielenie zamówienia, dokumenty składa każdy członek konsorcjum); D. Podmioty zagraniczne: Jeżeli Wykonawca ma siedzibę lub miejsce zamieszkania poza terytorium Rzeczpospolitej Polskiej, zamiast dokumentów, o których mowa w punkcie C - Wykonawca składa dokument lub dokumenty wystawione w kraju, w którym ma siedzibę lub miejsce zamieszkania, potwierdzające odpowiednio, że nie otwarto jego likwidacji ani nie ogłoszono upadłości. Dokumenty, o których mowa w powyższych punktach C i D powinny być wystawione nie wcześniej niż 6 miesięcy przed upływem terminu składania wniosków o dopuszczenie do udziału w postępowaniu o udzielenie zamówienia.. Jeżeli w miejscu zamieszkania osoby lub w kraju, w którym Wykonawca ma siedzibę lub miejsce zamieszkania, nie wydaje się dokumentów, o których mowa w pkt C i D powyżej, zastępuje się je dokumentem zawierającym oświadczenie złożone przed notariuszem, właściwym organem sądowym, administracyjnym albo organem samorządu zawodowego lub gospodarczego odpowiednio miejsca zamieszkania osoby lub kraju, w którym Wykonawca ma siedzibę lub miejsce zamieszkania. Okresy ważności dokumentów, o których mowa w powyższych punktach C i D stosuje się odpowiednio. Kryteria Oceny Ocena spełniania warunków udziału w postępowaniu zostanie dokonana w oparciu o informacje zawarte w wymaganych dokumentach i oświadczeniach, według formuły: spełnia / nie spełnia. III.2.2) Economic and financial ability: Information and formalities necessary for evaluating if the requirements are met: I. Economic Operators may apply for a contract awarding if they satisfy all the following conditions: A. Economic Operators who within the last 3 (three) business years before the deadline for filing applications for participation in the proceedings or if the time in which they run their business is shorter - in such a time - have obtained an average annual turnover not EN Standard form 05 - Contract notice utilities 10 / 27

11 lower than PLN (in words: one hundred million PLN); and B. Economic Operators who have financial resources or creditworthiness of at least PLN (in words: twenty million PLN); and C. Economic Operators who have current third party liability insurance covering their activities related to scope of the award in an amount not lower than PLN (in words: ten million PLN). II. Documents required to confirm that the conditions of economic and financial capacity are met: The Economic Operator shall submit the following documents in order to prove that he meets the conditions specified for participants in the proceedings and described in item I (A, B and C) above: 1. Financial statement or relevant part of the financial statement (i.e. at least annual balance sheet and income statement) for the last 3 (three) business years, or if the time in which the Economic Operator runs his business is shorter - for such a time, confirming the average annual turnover not lower than PLN (in words: one hundred million PLN); if the financial statements are subject to audit, the chartered auditors' opinion has to be enclosed in compliance with accountancy regulations; in the case where Economic Operators are not obliged to prepare financial statements, other documents confirming their turnover shall be submitted; 2. Statement of the bank or savings and loan institution, in which the Economic Operator has an account, that confirms the amount of financial resources or creditworthiness of at least PLN (in words: twenty million PLN), issued not earlier than 3 months before the deadline for filing applications for participation in the proceedings. 3. Paid-in insurance policy or, in the absence of such policy, another document confirming that the Economic Operator has a third party liability insurance in place covering his activity in the scope of conducted business activity connected with the scope of the award for the amount not lower than PLN (in words: ten million PLN). In the case when there is no possibility to check that such document was paid-in, the Economic Operator shall provide evidence of payment of the insurance policy. Evaluation Criteria Qualifying evaluation shall be made on the basis of required documents and declarations, according to the criterion: meets or does not meet the criterion. O udzielenie zamówienia mogą się ubiegać Wykonawcy, którzy jednocześnie: A. posiadają średni roczny obrót w ciągu ostatnich 3 (trzech) lat obrotowych poprzedzających termin składania wniosków o dopuszczenie do udziału w postępowaniu, a jeżeli okres prowadzenia działalności jest krótszy - w tym okresie, w wysokości nie mniejszej niż PLN (sto milionów złotych); oraz B. posiadają środki finansowe lub zdolność kredytową w kwocie nie mniejszej niż PLN (dwadzieścia milionów złotych); oraz C. posiadają ubezpieczenie od odpowiedzialności cywilnej w zakresie prowadzonej działalności związanej z przedmiotem zamówienia na sumę nie mniejszą niż PLN (dziesięć milionów złotych). Dokumenty wymagane w celu potwierdzenia spełnienia warunków w zakresie zdolności ekonomicznej i finansowej: Wykonawca przedstawi następujące dokumenty na potwierdzenie spełniania warunków udziału w postępowaniu o udzielenie zamówienia, opisanych powyżej w punkcie I (A, B oraz C): 1. Sprawozdanie finansowe lub odpowiednią część sprawozdania finansowego (tj. przynajmniej bilans oraz rachunek zysków i strat) za ostatnie 3 (trzy) lata obrotowe, a jeżeli okres prowadzenia działalności przez Wykonawcę jest krótszy - za ten okres, określające średni roczny obrót na poziomie przynajmniej PLN (sto milionów złotych); jeżeli sprawozdanie finansowe podlega badaniu przez biegłego rewidenta zgodnie z przepisami o rachunkowości należy załączyć również opinię odpowiednio o badanym sprawozdaniu albo jego części; w przypadku, gdy Wykonawcy nie są zobowiązani do sporządzania sprawozdań finansowych, należy złożyć inne dokumenty określające ich obrót; 2. Informację z banku lub spółdzielczej kasy oszczędnościowo-kredytowej, w których Wykonawca posiada rachunek, potwierdzającą wysokość posiadanych środków finansowych lub zdolność kredytową Wykonawcy w kwocie nie mniejszej niż PLN (dwadzieścia milionów złotych), wystawioną nie wcześniej niż 3 miesiące przed upływem terminu składania wniosków o dopuszczenie do udziału w postępowaniu. 3. Opłaconą polisę, a w przypadku jej braku, inny dokument potwierdzający, że Wykonawca jest ubezpieczony od odpowiedzialności cywilnej w zakresie prowadzonej działalności związanej z przedmiotem zamówienia na sumę nie mniejszą niż PLN (dziesięć milionów złotych). W przypadku, gdy niemożliwe będzie zweryfikowanie, czy taki dokument został opłacony, Wykonawca dostarczy dowód poświadczający opłacenie polisy ubezpieczeniowej. 13 w oparciu o informacje zawarte w wymaganych dokumentach i oświadczeniach, według formuły: spełnia / nie spełnia. W przypadku Wykonawców wspólnie składających wniosek o dopuszczenie do udziału w postępowaniu, ocena spełniania przez nich warunków udziału w postępowaniu będzie dokonana łącznie. III.2.3) Technical capacity: Information and formalities necessary for evaluating if the requirements are met: Economic Operators may apply for a contract awarding if they satisfy all the following conditions: 1. The Economic Operators who have their own technology or license for FGD wastewater treatment. 2. The Economic Operators who have performed over the past 10 years before the deadline for filing applications for participation in the proceedings, or if the time in which the Economic Operator runs his business is shorter - in such shorter time, at least 2 (two) supplies constituting turnkey contracts including the design and erection of FGD wastewater treatment plants/systems according to European codes and standards, wherein FGD is defined as wet flue gas desulfurization process. The references shall be comparable in size, application and limits, which is understood as compliance with the followings (to be met jointly): Raw effluent from FGD system having concentrations of at least: - chlorides mg/dm³ - solids mg/dm³ Treatment effectiveness achieved to reduce the level of: - solids concentration - heavy metals concentration to values below the limits stipulated by Regulation of the Minister of the Environment dated 24 July 2006 on conditions to be fulfilled at the discharge of effluents to water or soil and on substances posing particular threat to aquatic environment (Dz.U no. 137, item 984) with further amendments The flow rate of raw wastewater at least 15 m³/h (designed hourly average yield). 3. The Economic Operators shall demonstrate having implemented and maintained a quality, an environmental and a health and security management systems preferably according to the standards of: EN ISO 9001; ISO 14001; OHSAS or MASE or VCA respectively or equivalent. In case the Economic Operators have no implemented and maintained systems according to above mentioned standards, and present their own (equivalent) system, as the minimum requirement within this area there is at least one year of the keeping of quality management EN Standard form 05 - Contract notice utilities 13 / 27

14 system with documented relevant policy and records allowing to confirm its implementation. II. Documentation to be provided by the Economic Operators in order to justify the compliance to the technical qualification criteria: Ad 1. Patent or evidence of proprietary technologies, or a valid license, giving the area of licensing for FGD wastewater treatment plant. Ad 2. Table with the list of supplies (FGD wastewater treatment plant turnkey contracts) performed properly, in the scope defined in item I condition 2 above, over the last 10 years before the deadline for filing applications for participation in the proceedings, or if the time in which the Economic Operator runs his business is shorter -over such shorter time. Such table shall precise: subject matter (including FGD and FGD WWTP type, receiver of wastewater type, raw wastewater flow rate, inlet concentrations of chlorides and solids, guaranteed performances for solids and heavy metals concentrations, main codes and standards implemented), commercial operating dates and buyers, as well as documents confirming that the scope of the works included in the list have been taken over by the buyers properly. Ad 3. Copies of the valid (i) EN ISO9001, (ii) ISO14001 and (iii) OHSAS 18001, or (alternatively) MASE, or (alternatively) VCA - or equivalent certificates certified by the Economic Operators as true copies. For non-certified management systems the Economic Operators are obliged to make an appropriate statement and to present the adequate evidence of keeping such systems. Qualifying evaluation shall be made on the basis of required documents and declarations, according to the criterion: meets or does not meet the condition. In case of entities jointly submitting an application for participation in the proceedings, their technical capacity will be evaluated jointly. / I. Wykonawcy, którzy posiadają własną technologię lub licencję dla oczyszczania ścieków z odsiarczania spalin. 2. Contracting Authority shall qualify to the next step of the procedure all Economic Operators who meet the participation requirements. 13. Awarding Authority shall conduct the bargaining procedure in cycles and reserve the right to reduce the number of Contractors after each such cycle based on conditions defined in the invitation to the particular bargaining cycle. 16. In order to fulfill the conditions for participation in the contract award procedure, the Economic Operator may rely on other entities, irrespective of the nature of their legal relationship, as per conditions determined in the contract notice. In such case, the Economic Operator is required to prove to the awarding entity that he shall dispose of the resources necessary to perform the contract, in particular by presenting to this end a written commitment of those entities whereby they undertake to put the necessary resources at the Economic Operator's disposal for the time of their use in performance of the contract. The awarding entity may require that the entity which the Economic Operator relies upon in respect of the fulfillment of conditions for participation in the award procedure shall take part in the execution of the contract as a subcontractor. Should the above mentioned third entity not meet terms and conditions for participation in the procedure, the awarding entity shall be entitled to communicate this fact to the Economic Operator and call him to present a subcontractor who would satisfy the awarding entity's requirements, under pain of excluding this Economic Operator from the procedure.
